Terms and Conditions of Use

Any use of this website is subject to the following terms and conditions, which are correct as at the date of the last review by the Editors but are subject to change at any time. These terms and conditions are governed by English law and are subject to the exclusive jurisdiction of the English Courts.

Disclaimer

In these terms and conditions:

University Network means any resources which are used for the transmission or reception (either wholly or in part) of any data (including voice, e-mail, video, web content or any other types or formats of data), which are owned or operated by or on behalf of the University.

University Services means any and all services provided by the University or on its behalf for use by its community and members by means of, or relating to the use of, access to or interaction with, the University Network. This includes the provision of any applications, information, services or facilities (either accessed directly or indirectly via the University Network); e-mail, web applications (including but not limited to the Portal), computing facilities (including but not limited to workstations, access services for personal systems such as dial up, VPN, wireless, self service).

The University takes all reasonable steps to ensure that the University Services and the University Network are error and virus free including by conducting regular virus cleaning operations. However, because of the nature of the University Network and the access to it by persons outside the control of the University, including students and other Members of the University using their own personal computers, the University does not guarantee continuous, uninterrupted or secure access to the University Network, nor does it guarantee that the University Services are virus or error free. Accordingly, the University Services and University Network are provided "as is" and as and when available, and to the extent permissible by law, the University hereby excludes all implied warranties, conditions or other terms, whether implied by statute or otherwise, including without limitation any terms as to skill and care or timeliness of performance, or that neither the University Services nor the University Network are secure, error and/or virus free.

The Website

By their nature, websites are subject to constant change. Whilst all reasonable efforts are made to ensure that the content of the University’s website is accurate and up-to-date, all content, services and materials are provided “as is” and the University reserves the right to alter these at any time. The University will not be held liable for the content of any such pages and makes no representations or warranties, express or implied, as to their content.

Accessibility

The University is committed to making its website as easily and widely accessible as possible, irrespective of the browser you are using. Our central website has been designed to conform to Section 508 and W3C Web Accessibility Initiative (WAI) standards. Force Majeure

The University will not be held liable for any loss, damage or expense resulting from any delay, variation or failure in the provision of programmes of study, services or facilities arising from circumstances beyond the University's reasonable control, including (but not limited to) war or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, interruption in power supplies or other services for any reason, fire, boycott, and telecommunications failure.

In the event that such circumstances beyond the reasonable control of the University arise, it will use all reasonable endeavours to minimise disruption as far as it is practical to do so provided that such endeavours do not undermine the University’s Quality Assurance requirements.

Disclaimer

The University of Southampton will use all reasonable efforts to deliver advertised programmes and other services and facilities in accordance with the descriptions set out in the prospectuses, student handbooks, welcome guides and website. It will provide students with the tuition and learning support and other services and facilities so described with reasonable care and skill.

The University undertakes a continuous review of its programmes, services and facilities to ensure quality enhancement. The University is also largely funded through public and charitable means and is required to manage these funds in an efficient and cost-effective way for the benefit of the whole of the University community.

The University, therefore, reserves the right if it considers it to be necessary:

1) Change or Discontinuance of Programmes

If the University discontinues or combines a programme of study or changes it significantly:

A) In the event that the University has not made an offer of a place or before an applicant has accepted an offer:

(i) the University will inform applicants at the earliest possible opportunity of the discontinuation or change

(ii) an applicant will be entitled to withdraw his or her application by informing the University in writing within a reasonable time of being told of the discontinuation or change, failing which the University will withdraw its offer of a place.

B) In the event that an offer has been accepted but prior to the student enrolling, the student may either:

(i) withdraw from the University and be given an appropriate refund of tuition fees and deposits, or

(ii) transfer to another available programme (if any) as may be offered by the University for which the student is qualified.

If in these circumstances the student wishes to withdraw from the University and to apply for a programme at a different university, the University shall use its reasonable endeavours to assist the student.

2) Changes to Services or Facilities

The University will make available to students such learning support and other services and facilities as it considers appropriate, but may vary what it provides from time to time (for example, the University may consider it desirable to change the way it provides library or IT support).

3) Financial or Other Losses

The University will not be held liable for any direct or indirect financial or other losses or damage arising from such discontinuations, changes to or mergers of any programme of study, service or facility.

Upon acceptance by an applicant of an offer of a place at the University, the relationship between the applicant and the University becomes contractual. In entering into that contract, neither the student nor the University intends that any of the terms of the contract will be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person not a party to it.

Prospectuses

The prospectuses for undergraduates and postgraduates are produced by the University to help you choose your course of study. The online versions of the prospectuses are intended as guidance only and do not take precedence over the printed versions.

Every effort has been made to ensure the accuracy of the information contained in the prospectuses but they may be subject to change without notice. The University will use all reasonable efforts to deliver advertised courses in accordance with the descriptions set out in the prospectuses. However, the University reserves the right to vary the content or method of delivery of the course and to discontinue, merge or combine courses where the University deems this necessary. The University will not be held liable for any loss or damage arising from such variations or changes.

Copyright and Trade Marks

The University reserves all rights, including copyright, in the content of this website. Copyright exists in all original material published on the website by staff or students of the University and may belong to the author or to the University depending on the circumstances of publication.

In accessing this website, you agree that the downloading of content is for personal, non-commercial reference only. No part of the website may be reproduced or transmitted in any form or by any means, electronic, mechanical, photocopying, recording or otherwise, unless otherwise stated, without the prior written consent of the University. Permission to print one hard copy of any page held on the University's central web servers is granted to you for personal non commercial reference only.

Particular images and words used on the website are registered trademarks of the University and may not be used without permission. A full list of all registered trademarks belonging to the University is available from the patent office.

Freedom of Information Act 2000 (FOI)

Information held by the University is subject to the provisions of the Freedom of Information Act 2000 and subordinate legislation. This Act provides individuals with a right of access to recorded information, of any age, which the University holds, subject to certain exemptions. Data Protection

Any information provided by persons accessing the University’s website and other parts of the University Network shall be processed in accordance with the Data Protection Act 1998 and subordinate legislation. Privacy

Some sections of the University’s website may require you to provide personal information to us in order for us to provide a particular service e.g. ordering prospectuses, responding to queries, enrolling online. By providing this information you are consenting to the University processing your information for the purposes for which it was provided and for any other purposes to which you may have agreed.

Information collected from you will not be passed to any third party without your consent, except where we are under a statutory obligation or entitled to do so by law.

Cookies

Cookies are small text files passed by us to your computer’s hard drive via your browser. These may be used by the University to collect information for the purposes of managing and improving the services on the website and identifying you and preparing customised pages. Corporate and Marketing Services (CAMS) holds overall responsibility for the "top-level" organising pages of the University website. Similarly, such links may be to websites external to the University. The University will not be held liable for the content of any websites not under its direct control or for any consequences arising out of or in connection with accessing such websites.

Nothing in these Terms and Conditions shall limit the University’s liability for death or personal injury resulting from the University’s negligence or that of its subcontractors.
