Vasanti Selvaratnam QC, one of the Joint heads of the 36 Group and the newest member of the IML, has just published an article titled "Good Faith – Is English law swimming against the International tide?" in LMCLQ. The article was presented at the 2019 Donald O'May Lecture.
The article reviews developments in the English courts and internationally since the judgment of Leggatt J ( as he then was) in Yang Seng in which he concluded that English commercial law's failure to recognise a general duty of good faith is out of step with other major jurisdictions.
